Legal bases for Ecommerce Awards

1. Aim:
The present Legal Bases regulates the access and participation of any user in the Ecommmerce Awards Spain 2018 and Ecommerce Awards Europe 2018 (hereinafter, “Ecommerce Awards”), as well as the access and use of the website www.clubecommerce.com (hereinafter, the “Web”) and the contents and services included in it. The participation of a user in the Ecommerce Awards and the use of the Website imply the acceptance of these Legal Bases fully, expressly and without reservation. Anyone who does not accept these Legal Bases should refrain from participating in the Ecommerce Awards and using the Web.

In accordance with Law 34/2002, of July 11, on Services of the Information Society, we make available to users, the information relating to the identifying data ECOMMERCE ETC, S.L., as owner of the Website:

3. Requirements for registration

Those who may register at the Ecommerce Awards are internet sales platforms with B2C activity in Europe, that is, companies whose activity is the sale of products and / or services in Europe through the internet, for which a financial transaction is made through an online platform; and that they have read and accepted in full these Legal Bases and that they have correctly filled out all the fields marked as obligatory in the contest form accessible through the Web.

4. Price and form of registration

To participate in the Ecommerce Awards it is essential to fill in the corresponding form to the effect, specifying the mandatory data specified therein for the purpose of providing information to the professional Jury, in order to support their decisions in the awards.

Likewise, additional documentation may be requested to participants to justify participation in the contest, which in no case will be published on the Website and will be treated in a confidential manner.

The data provided by the participants during the registration procedure must be accurate and true. The organization is not responsible for the veracity of the information provided by the candidates, who guarantee and respond, in any case, for the validity, legality and legitimacy of the data and content provided. In this sense, the participant, who claims to be the owner of the contents and the intellectual property rights provided to present his candidacy, grants in favor of the organization, by sending them, a free, unlimited, level global and not exclusive license so that it uses, reproduces and shows them for the purposes of making public their candidacy for the Ecommerce Awards and to carry out any publicity-promotional activities related to them.

If a participant provides any false, inaccurate or incomplete information, or if the organization had sufficient reasons to suspect that the information provided was false, he / she will be entitled to withdraw the participant from the contest, even if he / she wins one of the prizes . Likewise, in case the organization detects that the information provided by the candidates does not conform to the parameters described in this section, it may invalidate their participation in the Ecommerce Awards.

5. Acceptance of Candidates

The organization of the contest reserves the right to admit or reject the proposed candidates if a commercial link with the e-commerce sector is not deduced, they do not belong to the proposed category and / or present any other deficiency or defect of form.

6. Registration Period

The registration period ends on May 17, 2018 for Ecommerce Awards Europe 2018 and on October 10th, 2018 for Ecommerce Awards Spain 2018. Any application received after those dates will be considered invalid and the candidates will not acquire the status of participants in the contest. The organization of the event reserves the right to extend the date depending on the volume of requests and regardless of whether the voting period has been opened.

7. Mechanics and the voting term

The votes will be made through the analysis of each of the juries chosen by the organization and the winners will be determined according to their criteria. The voting period will open on May 18, 2018 for Ecommerce Awards Europe 2018 and on October 11, 2018 for Ecommerce Awards Spain 2018.

8. Fraudulent Use

Any type of action on the part of the candidates is strictly prohibited, tending to modify, alter or influence the results of the contest and the designation of the winner, by any means or mechanism that may be considered abusive or fraudulent. The organization of the contest will analyze at the end of the voting period the register of votes in order to identify possible malicious uses and to obtain more votes or harm other candidacies. If it is presumed by the organization that a candidate has obtained votes in contravention of the provisions of these Legal Bases, by means of fraudulent means, including but not limited to the automated search or the use of algorithms, the organization reserves the right to subtract the votes that are considered irregular and even withdraw all the candidatures of the company if necessary in case of not receiving the allegations and justifications.

9. Awards

The awards have a symbolic value and recognition of the work of each of the candidates and represent the merit of the work done, considering the visibility generated as the main asset of participation in the contest.

The participation categories are the following:

Best Startup Webshop 2018

Requirements: Year created, 2016 or later.

Considerations: The ability that entrepreneurs have shown to quickly grow their business, get capital, as well as the year of creation and the originality of the idea will be valued.

Best Webshop Crossborder 2018

Requirements: Make more than 60% of your turnover outside of Spain.

Considerations: The capacity of the company to sell outside Spain will be valued, paying great attention to the total sums.

Best Mobile Strategy 2018

Requirements: Bill more than 30% of your sales via mobile.

Considerations: The existence of applications for specific mobile devices, and the rate of visits and sales through them will be assessed.

Best Omnichannel Strategy 2018

Requirements: Have at least 3 physical stores.

Considerations: The way in which the store has synergies between its’ ON and OFF channels will be valued.

Best Online Marketing Strategy 2018

Requirements: To have launched an online marketing campaign.

Considerations: The actual results at the sales level of the most significant campaigns will be valued as well as the originality of the same.

Best Digital Transformation Strategy 2018

Requirements: Investment in tools in at least 4 of the following categories, in the last 3 years: Collaboration tools, Customer tools, BI tools, Finance & Accounting tools, Communications tools, IT management tools, Human Resources tools and Sales tools.

Considerations: The economic growth related to the efficiency achieved through the incorporation of digital tools will be valued.

Best Digital Leader 2018

Requirements: Directors or founders who have 10 or more years of experience in the digital sector or 3 years in a company in the sector with a turnover above 50million €

Considerations: The milestones that you have achieved in your professional career and your contribution to the sector will be assessed.

Best Webshop Europe 2018

Requirements: They are eligible for at least 3 prizes of the above.

Considerations: Stores will be valued and scored taking into account all the evaluation criteria.

10. Jury

The jury will be selected by the organization taking into account factors of impartiality and representation of the different areas that represent business on the Internet.

The jury of the present edition of the Ecommerce Awards will be announced during the contest through the information channels of the organization.

11. Communication of the winners and the awards ceremony

The communication and awarding of prizes to the winners will take place during the gala dinner of the Digital 1to1 Europe to be held in June 2018 for Ecommerce Awards Europe 2018 and the gala dinner of the Digital 1to1 Spain Madrid to be held in October 2018 for Ecommerce Awards Spain 2018.

Participants who have been winners accept and authorize the use of their brand, trade name, company name and any other distinctive sign of the company, to be used for the purposes of making public, where appropriate, the results of the Ecommerce Awards. Likewise, they authorize the organizer to reproduce and use said distinctive signs in any publicity-promotional activity related to the Ecommerce Awards, without such use confers the right to remuneration or any benefit other than the delivery of the prize won.

The awards ceremony will take place at a location in Europe to be determined for Ecommerce Awards Europe 2018. The location for Ecommerce Awards Spain 2018 is Madrid and the place to be determined. In a festive format with all finalists invited. The details of the venue and the casuistry of the ceremony will be announced during the contest through the information channels of the organization.

12. Limitation of Liability

The organization reserves the right to withdraw, suspend or modify the contest and modify the content of these Legal Bases at any time, either temporarily or permanently, for reasons of security, restructuring or interruption of computer services, or in the assumption of any unforeseen circumstance that is beyond its reasonable control, whether fortuitous, force majeure or due to the irregular activity of the participants or a third party, without the organization incurring any liability to the participants, awarded or third parties.
The necessary modifications that have taken place in the contest or in the present Legal Bases will be published in the Web. Any user can check for an updated version of these Legal Bases on the Web.

The organization will not assume any responsibility derived from an inadequate or irregular operation of the electronic communication networks that impede the normal development of the voting and that has its origin in causes alien to the organization (whether or not attributable to a third party in bad faith).
The organization is not responsible for damages of any kind that may arise from the availability and technical continuity of the operation of the Website. In any case, the organization will carry out all the necessary actions to reestablish its services in case of technical failure.

13. Intellectual Property

All the contents that are part of the Web (information, articles, data, texts, logos, icons, images, external appearance, look and feel, sounds, audio, video, designs, creativities, software, etc.) belong to the organization or they are exploited under the license of third-party owners of the intellectual property rights of the aforementioned contents, and are protected by current legislation on industrial and intellectual property.

All trademarks, logos or distinctive signs of the organization indicated on the Website are trademarks owned by the organization. The reproduction, distribution and public communication of all or part of the contents of the Website for commercial purposes is expressly prohibited.

14. Links to third-parties

The Web access service may include technical linking devices, directories and even search tools that allow the user to access other websites and Internet Portals (hereinafter, Linked Sites).

The organization does not know the contents and services of the Linked Sites and, therefore, the organization does not make any statement or statement, nor accepts any responsibility for the quality, content, nature or reliability of the sites and content accessible through of links on the Web or sites with links to the Web. The Linked Sites are not under the control of the organization and the organization is not responsible for the content of any linked site or any link contained in a linked site, nor for any revision, change or update that takes place on such sites. 15. Acceptance of Legal Bases

The participation in the Ecommerce Awards implies the full and total acceptance of these Legal Bases by the candidates. Any manifestation in the opposite direction, that is to say, of non-acceptance thereof, will imply the exclusion of the participant and, as a consequence thereof, the organization will be released from compliance with the obligation contracted with said participant.

16. Interpretation

In case of doubts in the interpretation of these Legal Bases, the criterion of the organization will prevail. Any incident that may arise and that is not reflected in these Bases will be resolved by the organization, according to their knowledge and best criteria.

17. Nullity

If any provision of these Legal Bases is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only that provision or part of it that is null or ineffective, subsisting in all other rest of the clauses and having such disposition or the part of the same that is affected by not putting, except that, to be essential to the present bases, it had to affect them of integral form.

18. Applicable Law and Jurisdiction

The interpretation and compliance of the Bases will be governed by Spanish legislation, and for any dispute that may arise from the Ecommerce Awards, the courts of the city of Barcelona will be competent.
